▪️9/20 加州法官叫停微信禁令

美國加州地方法官Laurel Beeler 20日在禁止令(Preliminary Injunction)中，暫緩了美國商務部的針對微信的禁令。（全美試用）

法官判決認為，8 月 6 日的總統令及 9 月 18 日商務部實施細則，有違反憲法第一修正案、平權條款、程序正義條款等根本權利之嫌，且美國司法部提供的微信對國家安全構成的所謂威脅的證據明顯不足。

法官裁定:雖然某些法理上和事實上的細節問題尚未審清，但在法院最終判定總統令和實施細則是否違憲之前，該總統令和實施細則均不得實施，以免造成更多傷害。

美國微信用戶聯合會稱讚該裁決是「美國微信用戶的一項重要而艱辛的勝利」。

定義：如任何人參與被定為非法集結的集結的人破壞社會安寧，該集結即屬暴動，而集結的人即屬結暴動。(公安條例 . 第19條)
最高刑期：10年

美國 (聯邦法律)
人數下限：3人
定義：在集會中任何人的行為或或威脅構成明顯和即時危險，令任何財產或個人會被破壞或受傷。(18 . U.S. Code 2102)
最高刑期：5年

英國
人數下限：12人
定義：為共同目的使用或威脅使用非法暴力，導致在場人士擔憂人身安全，所有使用非法武力者即干犯暴動罪。(Public Order Act 1986, Section 1 )
最高刑期：10年

澳洲 (昆士蘭省)
人數下限：12人
定義：為共同目的使用或威脅使用非法暴力，導致在場人士擔憂人身安全，所有參與集結即干犯暴動罪。(Criminal Code Act 1899, Section 61)
最高刑期：3年 (一般參與者) / 7年 (持有危險武器或導致財物損失) / 終身監禁 (導致有人身體受嚴重傷害或使用爆炸品)

加拿大 (聯邦法律)
人數下限：3或12人 (以官方 『暴動公佈』進行驅散)

最高刑期：2年(一般參與者) / 10年 (以面罩或其他方法嘗試掩飾身份) / 終身監禁 (官方作出暴動公佈後 30 分鐘仍未自行散去者)

新加坡
人數下限：5人
定義：當非法集結中任何參與者使用武力或暴力以期達到共同目標，所有參與集結者即干犯暴動罪。(Penal Code, Section 146)
最高刑期：7年及笞刑 (一般參與者) / 10年及笞刑 (持有致命武器)

香港暴動罪，只要有任何一位在場集結人士，利用硬物拋向警察，而在場的所有人士都足以構成參與暴動。所以，盧偉聰所講的5人暴動，根本是言語偽術，欺騙港人的基本法律常識 ......

暴動罪，在這動盪不安的政治氛圍下，法律界人士應要行出一步，要求將定罪門檻收窄，人數由3人擴寬成12人以上才能達成暴動基本門檻。
