【#SAVE12】深圳鹽田檢察院就12名被送中港人案起訴其中10人 港大學生郭子麟涉嫌偷越邊境罪

深圳市鹽田區人民檢察院於今日（12月16日）晚上發出有關12名送中港人的案件通報，將對其中十名港人提起公訴。
當中鄧棨然及喬映瑜被控涉嫌組織他人偷越邊境罪。根據《中華人民共和國刑法》，此罪行一經定罪可被判監禁二至七年。惟條文亦指出若涉及「組織他人偷越國（邊）境集團的首要分子」、「多次組織他人偷越國（邊）境或組織他人偷越國（邊）境人口眾多的」、「以暴力、威脅方法抗拒檢查的」等情況，一經定罪可被判監禁七年以上的有期徒刑或終身監禁。另外，鄭子豪、嚴文謙、張俊富、張銘裕、黃偉然、黃臨福、李子賢、李宇軒、郭子麟八人被控偷越邊境罪，一經定罪可判處一年以下監禁。
兩名未成年的被送中港人為廖子文及黃臨福，深圳市鹽田區人民檢察院表示有關案件將擇日舉行不公開聽證，並「依法」作出決定。
12名被送中港人在8月23日起已被扣押於中國深圳鹽田看守所，至今已是第116日，其中郭子麟為港大工程學院2019-2020年度的一年級生。

【#SAVE12】Shenzhen authorities charge 10 of the 12 Hongkongers. HKU Student Jack Kok charged with crossing the border illegally.
Tonight (16/12), the Yantian District People’s Procuratorate released a statement concerning the 12 Hongkongers extradited to China. It is said that charges had officially been laid against 10 of the 12 Hong Kong detainees.
Tang Kai Yin and Quinn Moon are accused of organising the illegal crossing. While 8 of the 12 are charged with crossing the border illegally. Upon conviction, the sentence is up to 1 year in prison for the 8 of them.
The two minor detainees are Liu Sze Man and Hoang Lam Phuc. The statement said that a closed-door hearing will be conducted and decisions will be made “in accordance with the law”.
The 12 Hongkongers have been detained in Yantian Detention Centre in Shenzhen China since August 23. It has already been the 116th day. One of the detainees, Jack Kok, is a year 1 engineering student in HKU in 2019-2020.
