Res Judicata又稱為Claim Preclusion, 顧名思義就是之前甲案中原告(or被告)已經提出
(或是應提出而未提出)的訴訟理由(claim), 在乙案中就不得再提出. 換言之, 就算是再 提出來對造可基於Res Judicata原則請求乙案法官直接駁回該訴求.(If you have only one cause of action, you only have one bite of the apple.)

之前版上看到有專利同好提到美國法律中有關Res Judicata/Collateral Estoppel的問題,
以下就敝人對這兩個名詞之理解提出來供諸位隨便看看.
其實不管是Res Judicata或是Collateral Estoppel, 大致上都是因為前後分別有兩件
訴訟,如果第一個案子已經審結(以下稱甲案),那麼法院對該案之判決會如何影響後面
這個尚未審理的第二個案子呢(以下稱乙案)?
p.s.請別問小弟這兩個名詞該如何翻成中文, 因為我也不知道~~
Res Judicata又稱為Claim Preclusion, 顧名思義就是之前甲案中原告(or被告)已經提出
(或是應提出而未提出)的訴訟理由(claim), 在乙案中就不得再提出. 換言之, 就算是再
提出來對造可基於Res Judicata原則請求乙案法官直接駁回該訴求.(If you have only
one cause of action, you only have one bite of the apple.)
若在乙案中任一造要以Res Judicata為武器, 必需符合以下三條件:
1. 在甲乙兩案中的原被告兩造是同樣那兩位(個人或法人)
2. 甲案已審結(final judgment), 請注意這裡的審結也包含了一造判決(default
judgment)但不包含基於管轄權(jurisdiction)或適格法院(venue)的判決.
3. 前後甲乙兩案均涉及相同一項訴訟理由(claim)或防禦理由(defense), 要注意的是聯
邦和州之間或州跟州之間對訴由(claim)的定義並不見得相同.舉例來說, 聯邦法院及多數
州法院認為從單一事件(transaction or occurrence)所衍生出來的議題(issue)都屬於
同一個訴由(claim), 但少數州法院認定原告對在同一事件中被侵犯的不同權利不屬於同
一訴由.
我知道我解釋的很爛, 所以舉兩個例子來彌補.
Hypo1: P和D開車相撞, 在甲案中P告D說D的駕駛疏失導致P受傷, 結果P贏了. 過了幾天,
P突然又想到在這場倒楣的意外中, D除了害他受傷之外也把P的車搞得半毀, 所以P又回到
法院另提乙案控告D的駕駛疏失致使P的車子損毀.
聯邦及多數州法院的見解是在甲案已結束之後, 不但在乙案中P不能對P的傷勢重新提告,
P也不能再控告D要求D賠P的車損, 這是因為P的人跟車都是在同一場車禍中受損, 所以P
必需在甲案中同時向D索賠人及車的損傷.
但有少數州法院則認為然是人是人, 車是車, 所以就算人車都是在同一場意外中受創, P
還是可以就人跟車分別提告.
Hypo2: P跟D在路上又相撞了, 這次P跟D兩個人都受了傷, 但在甲案中只有P先告D指控D的
駕駛疏忽害P受傷, 結果P贏了官司. 幾天後D想想很不爽,因為他也受了傷, 所以D就回到
法院另立乙案控告P在該意外中也有疏失並導致D受傷.
聯邦法院以及多數法院的見解是D不可以在乙案中控告P. 理由是P跟D都是在同一場意外
中受傷, 所以為了節省司法資源, 在P控告D的同時D就必需提出反訴(counter-claim),
既然D在甲案中並未提出反訴, D就不得在乙案中就同一事件對P提告. 值得注意的是某些
法院或學者把這種情況歸因於Compulsory Counter Claim而非Res Judicata.
