李卓人8.31案法庭陳情書
法官閣下,我在此認罪,但我在捍衛人民和平遊行和集會自由上,並沒有做錯任何事。我相信歷史將會宣判我們無罪。在此請讓我向你講述更多我的背景,那樣你就能更理解我為何要為了香港的未來,與人民共同走上街頭。
#新時代由政治犯開創
作為一名基督徒,我在復活節期間聽讀經員閱讀聖經,提醒了我,耶穌為世人犧牲,被釘上十字架,使罪人與神和解。從被捕到被控到被彼拉多(Pilate)判死刑,祂也是一名政治犯,沒有犯罪,但因為服務窮人和傳福音,而威脅到猶太統治階層。
縱觀人類歷史文明,我們現在享有的權利,也是由一眾政治犯,諸如甘地、馬丁路德金和納爾遜·曼德拉所開創的。在80年代,我是「香港反種族隔離運動」的主席,我一直將納爾遜·曼德拉在1963年遭審判所言銘記於心。他說:「願意為我的理想而犧牲自己生命。」他的理想是爭取南非黑人的平權,然後就被判刑27年。我為他在1994年當選南非總統而感到興奮,他給予了全世界受壓逼的人民希望,讓他們知道透過堅持不懈的鬥爭,可以達致公義。

我花了一些時間去講曼德拉帶給我的啟發,因為我是從1978年起投身到勞工權益和民主運動的。我畢生的理想,就是讓基層和被壓逼者勇於發聲和站起來爭取屬於他們的權利。每當那些被壓逼者起來捍衛他們的權利,為尊嚴而抗爭時,我也會受到鼓舞,並得到力量去繼續面對香港正面臨的艱苦奮鬥和挑戰。我曾問自己,沒有抗爭,我的人生將會是如何?這已是我第43年投身於民主運動,法官閣下,你必須明白當我目睹國家權力如何使用武力鎮壓人民,令香港人受傷、受牢獄之苦或是流亡,以及香港民主倒退,人民的權利遭剝奪之時,心裏的痛苦和折磨。我看到我的理想正在崩潰,但即使被黑暗籠罩,也無阻我繼續為理想奮鬥的決心。為了這一理想,我甘願承受任何懲罰。
法官閣下可能會說,法律就是法律,而我好像沒有就八三一案展露出絲毫悔意。我希望法官閣下明白,我是何等重視人民透過言論和集會所彰顯的自由。這是弱勢和受壓逼者尋求公義的唯一路徑。剝奪了這種權利,形同制度對人民施暴。我不願看見香港人活在建基於制度暴力的管治之中。因此,我會竭盡所能,伸張人們有尊嚴及和平遊行去發達意見的權利。

我十分尊重法官閣下維護法治的熱誠。在此,我希望能引用已故法官Ruth Bader Ginsburg的話:
「法官們會不斷思考和改變,我希望倘若今日法庭有盲點,明日它將會睜開眼。」
我十分敬佩Ginsburg為了性別平權奮鬥一生,成就斐然。她告訴我們,法官應該與時並進,趕上不斷在變遷的時代。在香港,最壞的尚未來臨,我們需要法律界人士去睜開雙眼,觀看人民的苦難,並反思法律在這個時代的立足點,如何隨時代變遷而轉變,以捍衞人民的尊嚴與權利。

"History will absolve us"
Submission of Lee Cheuk Yan to the Court
Your Honour, I plead guilty but I’ve done no wrong in affirming the rights of people to peaceful procession and I believe history will absolve us. May I give you more on my background so as your honour can understand why I decided to march with the people for the future of Hong Kong.
As a Christian, during Easter when the scripture was read, I was reminded how Christ went to meet his fate on the cross, sacrificing for mankind to reconcile sinners with God. From His arrest to his prosecution to his death sentencing by Pilate, he was a political prisoner who committed no crime apart from seen to be a threat to the Jewish Hierarchy by serving the poor and oppressed and preaching the good news.
Throughout history of mankind, the rights that humankind now enjoyed were pioneered by political prisoners from Gandhi to Martin Luther King to Nelson Mandela. I was the Chairman of Hong Kong anti apartheid movement back in the 80s and I always remember the determination of Nelson Mandela when he said during his trial back in 1963: “an ideal for which I am prepared to die for.”. His ideal was the equality for black South African and then he spent 27 years in jail. I was thrilled that in 1994, he was elected President of South Africa, giving hope to oppressed all over the world that justice can be achieve through the persistent struggle of the people.
I went to length about his inspiration to me personally because I started my activism starting 1978 for labour rights and democracy. My lifetime ideal is the empowerment of the poor and oppressed to speak out, to rise up for their rights. Whenever the oppressed assert their rights to fight for their dignity, I feel myself also empowered and inspired to continue the difficult struggle and challenges facing Hong Kong. I asked myself, what is my life without the struggle. The struggle is my life, I cannot imagine my life without it. It had been forty three years of struggle for me and your Honour must understand my deep felt pain and sufferings to see how the State Power had been using brute force against the people and the sacrifices of so many Hongkongers who were injured, jailed or exiled, also to witness the deprivation of the basic rights of the people and the regression in democracy. I saw my ideal crumbling but I will continue the struggle even though darkness is surrounding us. It is an ideal for which I am prepared for any sanction.
Your Honour may say the law is the law, I seems not show any remorse in breaching law in this trial for August 31st. I hope Your Honour understand the utmost importance I put on the rights to freedom of expression through speech or assembly. This is the only avenue the weak and oppressed can have to right the wrongs on them. If deprived, I will call this systemic violence on the people and I do not want to see Hong Kong rule on the basis of such systemic violence. Therefore I would do my utmost to affirm the rights of people to a dignified and peaceful procession to express themselves.
Your Honour must be passionate about upholding the law and I respect your ideal. I hope I can quote from the late Judge Ruth Bader Ginsburg:
“Justices continue to think and can change. I am ever hopeful that if the court has a blind spot today, its eye will be open tomorrow”
I was very impressed with her passion for gender equality and how she fought her whole life for gender equality and was able to achieve so much. Her message was time changes and judges should catch up with time. For Hong Kong, the worst may yet to come, and we need the legal profession to open their eyes to the suffering of the people and reflect on which side the law is with and how to changes with time for the advancement of the rights and dignity of the people.
I humbly submit myself to your sentencing and whatever your sentence, I have no regret for standing up for the rights of the people.

Normal Family life (Grasth) is encouraged, celibacy or renunciation of the world is not necessary to achieve salvation. The devotee must live in the world yet keep his mind pure. He must be a soldier, a scholar, a saint.
"Beauteous lady! hast not heard with thy ears, To the husband's home must thou come, nor for ever canst thou in the parental home abide" (Guru Nanak, Sri Rag)
"I that in the parents home on the Lord meditated, In the husband's home bliss have found. Blessed is the entire life of such." (Guru Ram Das, Sri Rag)
"Those known as celibates knowing not the right device, discard house and home." (Guru Nanak, Asa)
"Forsaking the household, one's mind took him to the forest, but it could not get peace even for a moment; but when it sought the refuge of the Saint of the Lord, its wanderings ceased and it returned to its own home. One abandoned his relatives and became a Sannyasi, but the craving of the mind did not cease. One's desires are not finished without the Word of the Guru, which alone can bring peace. When hatred for the world wells up in ones mind, he becomes a naked recluse, but the mind wanders ceaselessly and these wanderings do not end his desires, but when he meets the saints, he reaches the House of Mercy. Siddhas learn numerous Yogic poses; but their mind only after miraculous powers yearns. Thereby comes not to them fulfilment, content and peace of mind." (Guru Ram Das, Bilaval)
The Sikh Holy Book (Guru Granth Sahib) is the perpetual Guru, there is no place in Sikhism for a living Guru today.
"The bani is the preceptor and the preceptor is the bani, All the nectars are present in the bani: If the faithful follows the bani of the preceptor, The preceptor himself helps him in the realisation of his ideal." (Guru Ram Das, Nat)
Sikhism rejects all distinctions of caste, creed, race or sex.
"All are created from the seed of God. There is the same clay in the whole world, the potter (God) makes many kinds of pots." (Guru Amar Das, Bhairo)
"Recognise the light (of God) and do not ask for the caste, There is no caste in the next world." (Guru Nanak, Asa)
The Guru's stressed the full equality of women, rejecting female infanticide, sati (wife burning), permitting widow remarriage and rejects purdah (women wearing veils).
"We are born of woman, we are conceived in the womb of woman, we are engaged and married to woman. We make friendship with woman and the lineage continued because of woman. When one woman dies, we take another one, we are bound with the world through woman. Why should we talk ill of her, who gives birth to kings? The woman is born from woman; there is none without her. Only the One True Lord is without woman" (Guru Nanak, Var Asa)
"They cannot be called satis, who burn themselves with their dead husbands. They can only be called satis, if they bear the shock of separation. They may also be known as satis, who live with character and contentment and always show veneration to their husbands by remembering them." (Guru Amar Das, Var Suhi)
Honest labour and work (Kirat Karna) are the approved way of living ones life. It is considered honourable to earn ones daily bread through honest work and not by begging or dishonest means.
"He who eats what he earns through his earnest labour and from his hand gives something in charity; he alone, O Nanak, knows the true way of life" (Guru Nanak Dev, Rag Sarang, pg. 1245)
Vand Chhakna, sharing with others is also a social responsibility. The individual is expected to help others in need through charity.
Seva, community service is also an intergral part of Sikhism. The free community kitchen (langar) found at every gurdwara and open to people of all religions is one expression of this community service.
The #HarmandirSahib , also #DarbarSahib , referred to as the "#GoldenTemple", is the holiest #Sikh #gurdwara(#Temple) located in the city of #Amritsar, #Punjab, India. The city was founded in 1574 by the fourth Sikh guru, #SriGuruRamDasJi. The Golden Temple was designed by the fifth guru, #SriGuruArjanDevJi. Sri Guru Arjan Dev Ji completed the Adi Granth, the holy scripture of #Sikhism, in 1604 and installed it in the gurdwara.
There are four doors to get into the Harmandir Sahib, which symbolise the openness of the #Sikhs towards all people and #religions.
The Harmandir Sahib is considered holy by #Sikhs. The #holiest text of Sikhism, the Guru Granth Sahib, is present inside the gurdwara during daytime and the #holy book goes for #Sukhasan during the night time. Its construction was mainly intended to build a place of worship for men and women from all walks of life and all religions to come and worship God #equally.Over 100,000 people visit the holy shrine daily for worship, and also partake in the free community kitchen and meal (#Langar) that is a hallmark of all Sikh Gurudwaras.
The philosophy of Sikhism is covered in great detail in the #GuruGranthSahib, the #Sikh holy text. Detailed guidance is given to followers on how to conduct their lives so that peace and salvation can be obtained in this life, rather than the afterlife. The holy text outlines the #positive actions that one must take to make progress in the evolution of the person. One must remember the #Creator at all times – it reminds the follower that the "soul is on loan from #God, who is ever #merciful", and that the follower must dedicate their life to all good causes - to help make this life more worthwhile.
The Sikhs must believe in the following values:
#Equality: All #humans are #equal before God – No #discrimination is allowed on the basis of #caste, #race , #gender , #creed, #origin, #color, #education, #status, #wealth, et cetera. The principles of universal equality and brotherhood are important pillars of Sikhism.
Personal right: Every person has a right to life but this right is restricted and has attached certain duties – simple living is essential. A Sikh is expected to rise early, meditate and pray, consume simple food, perform an honest day's work, carry out duties for his or her family, enjoy life and always be positive, be charitable and support the needy, et cetera.
Actions count: Salvation is obtained by one’s actions– good deeds, remembrance of God – Naam #Simran, #Kirtan.
Living a family life: Encouraged to live as a family unit to provide and nurture children for the perpetual benefit of creation (as opposed to sannyasa or living as a monk, which was, and remains, a common spiritual practice in India.)
Sharing: It is encouraged to share and give to charity 10 percent of one’s net earnings.
Accept God’s will: Develop your personality so that you recognise happy events and miserable events as one – the will of God causes them.
The four truths of life: Truth, contentment, contemplation and Naam (in the name of God).

Taiwan is on the verge of becoming the first Asian government to legalize marriage equality. But the public is deeply divided.

In October 2014, a crowd at an LGBT rights rally in Taipei, one of many, lobbed four large red balloons emblazoned with the Chinese characters for marriage equality into the fenced courtyard of Taiwan’s legislature. At that time, a comfortable majority of Taiwanese supported same-sex marriage; a number of polls in the self-governing island of 23 million indicated as much, with one showing as many as 71 percent in favor. But several initiatives to amend the law to achieve marriage equality, first mooted in 2003, have not been successful. Two years later, three marriage equality bills now sit on legislators’ desks; although international media have been quick to announce that Taiwan stands on the cusp of being the first government in Asia to achieve marriage equality, the island’s public seems deeply divided. In the latest poll on the subject, released on Nov. 29, 46 percent of respondents supported marriage equality, while 45 percent opposed it. Meanwhile, Taiwan’s lawmakers and its civil society have been more cautious than recent headlines in Western media suggest.

Island-wide marriage equality initiatives have been unsuccessful in spite of growing support over decades. Even without national legislation, many local governments in Taiwan now allow same-sex couples to participate in collective weddings and to record their partnership in household registries across the island, although neither action confers any legal rights.

To many, the election of President Tsai Ing-wen and her Democratic Progressive Party (DPP) in January portended a broader, deeper change. Tsai openly made statements that appeared to support marriage equality during and after her campaign. In an October 2015 Facebook video posted to coincide with Taipei’s annual LGBT pride parade, Tsai exclaimed, “Everyone is equal before love.” A year later, she posted a photo on her Facebook page showing a rainbow, adding that her “belief has not changed” post-election. In August, Tsai appointed the first transgender official in government, Audrey Tang, as executive councilor for digital policy, which looked like another step toward acceptance of different gender norms.

The party that Tsai leads, the DPP, “has neither devoted sufficient resources to communicate the issues of marriage equality nor to reconcile differences within the party,” Victoria Hsu, who heads the nonprofit Taiwan Alliance to Promote Civil Partnership Rights (TAPCPR), told Foreign Policy.

It was therefore a setback when Justice Minister Chiu Tai-san announced in August that his ministry still intended to introduce its own same-sex partnership bill — but only in 2017, after studying the impact of such a law on Taiwanese society. (In Taiwan, ministries can introduce bills into the legislature.) The effort dates back to the previous, more socially conservative Kuomintang (KMT) administration of Ma Ying-jeou and is an attempt to compromise between supporters of marriage equality and religious groups opposed. Proposing a separate law for same-sex partnership is politically easier, as it leaves the institution of marriage as currently constituted unchanged.

In the absence of strong top-down leadership on the issue from Tsai, momentum for the bills currently under consideration has come from the bottom up. This summer, a number of Taiwanese pop artists organized a benefit concert to raise awareness for marriage equality; tickets sold out in minutes. Pop superstar Jolin Tsai performed a lesbian-themed song for the occasion. In the music video for the song “We’re All Different, Yet the Same,” she makes the case for marriage equality by describing the plight of a woman whose partner of more than 30 years is hospitalized; the woman is unable to sign a consent form for emergency surgery because she is legally not a spouse or family member.

A real-life version of this tragedy triggered public outcry and reinvigorated support for marriage equality. On Oct. 16, 67-year-old French professor Jacques Picoux fell to his death from the top of a 10-story building in Taipei, police said. He is thought to have committed suicide after depression caused by the death of his partner due to cancer; Picoux was unable to make medical decisions for his partner in his final days, as Picoux had no legal status. In a response to this outcry, legislators from the DPP and the KMT, as well as the caucus of the New Power Party (NPP), a young activist organization, all introduced similar marriage equality bills.

All three proposals would amend the Taiwan Civil Code to open marriage to same-sex couples, but they differ in how to do so. DPP legislator Yu Mei-nu’s proposal introduces a general provision extending to same-sex couples the right to marriage, as well as other family law rights that accompany married status. But it leaves further gendered language across the civil code intact. The proposals of KMT legislator Hsu Yu-ren and the NPP would make references to “husband and wife” and “father and mother” gender-neutral throughout all relevant civil code provisions. These latter two proposals have great symbolic meaning, because they remove a heterosexual presumption from the code, but the legal effect is likely no different than Yu’s proposal.

There is still a long legislative road to travel before Taiwan can become the first Asian government to legalize same-sex marriage. The bills passed their first reading on Nov. 17, but the DPP caucus whip has said the proposed bills will next be reviewed on Dec. 26. During the review process, any legislator can introduce a competing same-sex partnership act. Even if the bills were to enter a second reading, they could still face a boycott and be removed from the agenda. The bills will only become legislation after passing three readings.

It is hard to tell whether the legislature will pass a same-sex marriage bill this time, says Hsu of TAPCPR, partly because of internal opposition within the DPP and KMT. (The NPP caucus fully supports its bill but only holds five seats in legislature.) Tsai has reiterated that the bills are “clear evidence” marriage equality has support across all parties. But even Yu, who introduced the DPP bill, says she is only cautiously optimistic about the chances of passing a marriage equality law.

Outside lawmakers’ offices, the battle for public support continues. If anything, it seems to be waning precisely at the time when it will be most needed. “More and more people are confessing that they love gays but that they don’t support same-sex marriage,” said Ko, because they believe allowing same-sex partners to get married will harm traditional family values. She is therefore unsure whether Taiwan will manage to pass a bill in the next year. At least, Ko added, “people are talking [about it], and it is not a taboo anymore.”
