Asian-Americans Are Being Attacked. Why Are Hate Crime Charges So Rare?
On a cold evening last month, a Chinese man was walking home near Manhattan’s Chinatown neighborhood when a stranger suddenly ran up behind him and plunged ( ) a knife into his back.
For many Asian-Americans, the stabbing ( ) was horrifying, but not surprising. It was widely seen as just the latest example of racially targeted violence against Asians during the pandemic.
But the perpetrator ( ), a 23-year-old man from Yemen, had not said a word to the victim before the attack, investigators ( ) said. Prosecutors ( ) determined they lacked enough evidence to prove a racist ( ) motive ( ). The attacker was charged with attempted murder, but not as a hate crime ( ).
The announcement outraged ( ) Asian-American leaders in New York City. Many of them protested ( ) outside the Manhattan district attorney’s office, demanding that the stabbing be prosecuted as a hate crime. They were tired of what they saw as racist assaults being overlooked ( ) by the authorities ( ).
The rally ( ) reflected the tortured ( ) public conversation over how to confront ( ) a rise in reports of violence against Asian-Americans, who have felt increasingly vulnerable ( ) with each new attack. Many incidents have either not led to arrests or have not been charged as hate crimes, making it difficult to capture with reliable data the extent to which Asian-Americans are being targeted.
That frustration erupted on a national scale ( ) this week after Robert Aaron Long, a white man, was charged with fatally shooting eight people, including six women of Asian descent ( ), at spas in the Atlanta area on Tuesday night.
Other incidents that clearly seemed racially motivated have not resulted in arrests. The police are still searching for a man who called an Asian-American mother the “Chinese virus” and spat ( ) at her child in Queens last week.
In New York State, to charge ( ) such attacks as hate crimes, prosecutors would need to show that the victims were targeted because of their race.
But proving a racist motive can be particularly difficult with attacks against Asians, experts say. There is no widely recognized symbol of anti-Asian hate comparable to a noose ( ) or a swastika ( ). Historically, many Asian crime victims around the country were small-business owners who were robbed, complicating ( ) the question of motive.
Under New York State law, certain offenses can be upgraded to hate crimes, increasing the potential prison sentence ( ). As evidence, prosecutors often point to hateful verbal statements or social media posts by the defendant ( ).
In the past month alone, several assaults ( ) on Asian victims have been reported to the police, including an attack on an older woman who was pushed outside a bakery in Queens. None of the incidents has been charged as a hate crime.
In fact, the only person who has been prosecuted for an anti-Asian hate crime in New York City this year is Taiwanese. He was accused of writing anti-Chinese graffiti outside several businesses in Queens.
Wayne Ho, president of the Chinese-American Planning Council, a social services agency, said many of his Asian colleagues were verbally harassed ( ) during the pandemic but chose not to alert law enforcement because they worried the perpetrators, who were often people of color, could be mistreated ( ) by the police.
“I asked myself, do I want this person in jail?” said Alice Wong, one of Mr. Ho’s colleagues. “Just because you put someone in jail doesn’t make them not hate anyone anymore.”
Recognizing ( ) this challenge, some law enforcement officials have called for people who commit hate crimes to attend antiracism classes as an alternative ( ) to prison.

Qualified to the Final of World Athletics Cross Country Championships Bathurst 21 Global Challenge (Virtual Run) with a time of 34:57 min (10km) back in 20th March.
The Final have to run another 10km during 18-22nd June 2021.
I was planning to do it on Sunday, but when I realized I started off at a much faster pace, I then decided to push the pace, and did a 5KM Time Trial instead and clocked a 16:23 min (Season Best). A solid session leading up to the 10KM Time Trial two days later. Is like a simulation from last time at the track meets doing both 5000m and 10000m, where the 5000m in Day 1, and 10000m in Day 3.
Then here comes Tuesday morning (Yesterday), and is the final day to do it. I didn't sleep well last night and ended up woke up late at 8am, but I chose to do it anyway. With an average temperature of 31.5°C🌡️ and 79% humidity, it literally burn me out and I stopped at 4km with a time of 14:08 min (3:32 min/km). When Plan A is not working, let's go for the Plan B. Switch my focus on the evening, and let's give it another shot.
Pray for a good cooling weather, told myself that I will be fully recovered from the morning session, prime my mind ready for the time trial again.
It turned out the weather was great, and I took a sachet of Mitoceps (@mitocepsmalaysia ) 90 min prior to the session. Started the run at a pretty late time after unloading some weight and a short quick drills, and calm myself by listening to classic music.
Initially, I was targeting a Sub 34 min but after this morning condition, I decided to aim for a Sub 35 as the minimum goal.
Here is the 5k Splits:
17:10 | 17:55
The first half of the time trial was still pretty solid, but eventually I fall short of it on a later stage. I realized the pace was not getting back to what it was, turnover of the leg was dropping, the struggle was real from that point of time. Heart rate was consistently in between 174-176 bpm, I knew I have to either maintain the pace or slow down as there were still many laps to go.
From 82-84 sec per lap to 84-87 sec per lap for the next half was quite demotivating. And so, I gave my best effort, push the pace towards the end and clocked a 35:05 min.

Allen Iverson had every reason to feel good after his performance kept Philadelphia close to the division lead.
Surely the mood changed when the Sixers All-Star found out he was injured.
Iverson outperformed Kobe Bryant, scoring 36 points and leading a decisive third-quarter run in the 76ers' 108-91 win over the Los Angeles Lakers on Tuesday night.
Iverson helped pull the Sixers (31-33) to four games of Boston for first place in the Atlantic Division.
"It made me feel good," Iverson said. "Any win makes me feel good."
Iverson, though, chipped a bone in his left thumb sometime in the second half and will be fitted for a cast. He is day-to-day. The Sixers said Iverson will be re-evaluated Friday when they play again at Cleveland.
Iverson left the arena before the injury was announced.
The Sixers certainly need the league's leading scorer if they're going to make any kind of run at the Celtics.
"We would like to have that (winning) streak right now," said Iverson, before he knew the X-ray results.
Andre Iguodala scored 15 points for the Sixers, adding a few more spectacular dunks, including an alley-oop where he came crashing down on Jumaine Jones. Kyle Korver had 14.
Bryant -- who came in trailing Iverson by nearly two points in the league scoring race -- led the Lakers with 20 points, but had little help. The Lakers (32-31) fell out of the eighth and final spot in the Western Conference.
Bryant made five of nine shots in the first quarter, but went 1-for-6 the rest of the game.
"We've got to get more people involved," Bryant said. "They were doubling me and the shots weren't falling."
Iguodala had plenty to do with that. The Sixers rookie kept a hand in Bryant's face most of the game and aggressively contested his shots. Iguodala said he watched plenty of tape to prepare for one of his toughest assignments.
"I knew if I kept my hands up and kept nagging him a little bit that I could make him take a tougher shot," Iguodala said.
Bryant scored 16 points in the first quarter and Iverson had 14 as the two seemed poised for a one-on-one showdown between All-Stars. But Bryant slowed down, thanks largely to the sticky defense by Iguodala, while Iverson kept driving and crashing.
Iverson scored 14 points during a 26-9 run in the third quarter by doing what he does best -- drive the lane, look for the layup and get to the line. When he couldn't do that, Iverson would dribble around the perimeter until he found an open look.
He took six of Philadelphia's 16 shots in the third (making three) and went 7-for-7 from the line. Overall, Iverson went 14-for-15 from the line and 10-for-22 from the floor.
On one fallaway layup from the right side, Iverson was fouled by Chucky Atkins. Atkins bitterly complained and was hit with two quick technicals and ejected from the game.
Korver sank the two free throws for a 66-50 lead. Rodney Rogers hit a 3-pointer near the end of the third, giving Philadelphia a 28-point lead.
Chris Webber again was a non-factor for the Sixers. He scored Philly's first two baskets of the game, sat out 5 minutes of the second quarter and missed his last six shots for five points.
Webber remained baffled as to why he has looked little like the five-time All-Star he was in Sacramento. Of course, watching Iverson take a bulk of the shots and not having coach Jim O'Brien call plays for Webber might have something do with his struggles.
"I don't want to put my finger on it," Webber said. "It's not because it's late in the season. I didn't become this player in one day."
Game notes
Bryant, who went to nearby Lower Merion High School, needed about 30 tickets. Among those invited were players on this year's Merion team and his former coach, Gregg Downer. Lower Merion plays in the Class AAAA state semifinals Wednesday night. Bryant said he loved playing in Philadelphia, even though he's always booed. "If I played here, they'd love it with the Philly attitude I have," he said. "But I enjoy coming here because of that." ... The Sixers are 17-10 when Iverson scores 30 or more points
