Governors have lived for Hong Kong. One or two have literally died for Hong Kong. But all have found Hong Kong, in and out of office, an all-consuming interest. Retired to our grey and green island, past Governors have watched from afar with keen-eyed interest and, doubtless, occasional frustration as Hong Kong's history has unfolded. I shall do the same, carrying with me one frustration, gnawed by one anxiety, comforted by one certainty.
For me the frustration, the greatest in this job, is that I have not been able to put my personal view of Hong Kong's best interests to the test which legitimizes leadership in most free societies, the test of the ballot box.
But Hong Kong has been promised that its government will develop so that that can happen one day, a day I hope I shall see and a day that I shall be delighted to put down to China's credit and to the credit of those in this territory who have stood up bravely for the people of Hong Kong.
My anxiety is this: not that this community's autonomy would be usurped by Peking, but that it could be given away bit by bit by some people in Hong Kong.
We all know that over the last couple of years we have seen decisions, taken in good faith by the Government of Hong Kong, appealed surreptitiously to Peking - decisions taken in the interests of the whole community lobbied against behind closed doors by those whose personal interests may have been adversely affected.
That is damaging to Hong Kong because it draws Chinese officials into matters which should fall squarely within the autonomy of Hong Kong. If we in Hong Kong want our autonomy, then it needs to be defended and asserted by everyone here - by businessmen, politicians, journalists, academics and other community leaders, as well as by public servants.
And what of that truth which more than anything else gives me confidence in Hong Kong? The truth is this. The qualities, the beliefs, the ideals that have made Hong Kong's present will still be here to shape Hong Kong's future.
Hong Kong, it seems to me, has always lived by the author, Jack London's credo:
"I would rather be ashes than dust, I would rather my spark should burn out in a brilliant blaze,
Than it should be stifled in dry rot.
I would rather be a superb meteor,
With every atom of me in magnificent glow,
Than a sleepy and permanent planet."
Whatever the challenges ahead, nothing should bring this meteor crashing to earth, nothing should snuff out its glow. I hope that Hong Kong will take tomorrow by storm. And when it does, History will stand and cheer.

MEDIA STATEMENT: ACT AGAINST "PERIOD SPOT CHECKS" IN SCHOOLS
1. The current trending issue that has been going around on Malaysian students (former and present) are sharing disturbing stories of period spot checks and sexual harassment in school during the month of Ramadhan. Having to prove to their teachers and higher ups that they were on their period also means having their private parts touched without consent (on the context of teacher and student relationship) as well as having their panties removed to show their menstrual pads. These form of intrusion and violation of inappropriate touching, personal autonomy and body shaming through the excuse of ‘disciplinary punishment’ but in reality, it was entirely sexual harassment and abuse of power. A school or educational institutions should create an environment where students can be at peace of mind and feel safe from the secular world outside.
2. The fact that this mortifying misconduct is still happening to our students now without any measures being taken against the perpetrators is disgusting! We must stand together and put to an end of what seems so shockingly common in our society. The trauma and mental stress of being groped and touched without consent can be shattering, leaving the victim feeling traumatized, depressed and ashamed. Trauma has lasting effects.
3. Making the decision to report misconduct like such or sexual harassment takes a great deal of courage. I applaud those who gather every ounce of their courage in speaking up. Your voice is needed for the safety of other students in school and future generations to come.
4. I call upon the Ministry of Education to take prompt action and investigations by relevant authorities in ensuring that the safety of our school students will be the top priority. As schools are supposed to be conducive sanctuaries where students can feel safe and confident, let us not shatter that part of trust from our girls.
5. Sexual harassment has no place in a school. If this persist on, it defeats the purpose of an educational institution entirely.

【本研解密】「超譯」特權法
近日多名立法會議員被警方以《立法局(權力及特權)條例》控告干預立法會運作,翻查一系列關於《立法局(權力及特權)條例》立法的英國解密檔案【註一】,當時1985年的通過的特權法可謂為立法會充權的里程碑,但審議期間困難重重,引起不少爭議。當年英方內部討論今日解封,可為現今特權法被濫用提供莫大啟示。
當時仍屬親英的譚惠珠領頭審議草案委員會,負責擬定《立法局(權力及特權)條例》草案,打算確立立法會日後地位,保障97後的香港自主性。然而,由於條文中有誹謗性藐視(Defamatory contempt)的罪行,尤其第19條第2節中有禁止侮辱 (insult) 議員等字眼,大律師公會、香港律師會及記協等組織都大力批評條例有侵犯言論及新聞自由的風險。由於輿情驚動倫敦,最終港英回應訴求,刪減相關誹謗性藐視的條文,英方也表明港英需要吸收更多自主的經驗教訓(there is a need for the Hong Kong Government and UMELCO to learn the wider lessons of growing autonomy)。故此特權法不單止為立法會本身充權,當年在立法過程中也為體現香港步向自主上了重要的一課。
英方與港英政府其後進行賽後檢討,除了分析民間強烈反對的原因,包括港英錯誤預計公眾反應及欠缺政治觸覺(political feel)外,更提出一個具前瞻性的憂慮,特權法有機會被表面地解讀。當年仍任職英國外交部政務官的衛奕信講明,指望中方「合理」地應用法律條文顯然是不足的(with the Chinese dimension, it is clearly not sufficient to rely on the "reasonable" application of the law),難保日後會出現條文被表面地(literally)解讀及僵化地(rigidly)執行的情況,提醒港英日後立法應多加注意。有見今日政府表面地闡釋條文中「干預」、「藐視」及「阻礙」等行為,令立會主席「煩躁不安,精神受挫」也成為干預議會運作的理據【註二】時,相信已經違反英方合理地應用的立法原意。
時任英國外交部香港司司長高德年(Anthony Galsworthy)早就預視97後中方一定會向立法會施壓,因此,特權法中誹謗性藐視的條文本為防止議員受左報的個人攻擊(personal attack)。英方立法原意雖好,但若當初條文沒有受民間壓力而「減辣」的話,現時何君堯或聲稱自己在議會被「侮辱」,指控林卓廷等人藐視立法會,將原告變被告,特權法成為更具威脅性的法律武器控告議員。
同一條條例,今日香港政府透過刻意表面地解讀法律,將充權變削權,本身保障議員的特權法竟反控議員。這種中國式的法律應用下,任何法例都可能變成惡法,這也是法律武器化的其一表現。
